State Regulations:

• All Cosmetology licensees renewing their license must show the completion of at least 6 hours of
  continuing education.
• All Esthetician licensees must show the completion of at least 6 hours of continuing education.
• All Nail Tech licensees must show the completion of at least 6 hours of continuing education.
• Each licensee must obtain a Certificate of Completion for each class completed.
• These hours MUST include at least four (4) hours of Sanitation instruction.
• For late renewal, the continuing education courses must have been completed within the two year
  period immediately prior to the date of renewal.

Licensees must retain a copy of the certificate of completion for a course for 2 years after the date of completion.
Continuing education credit may not be obtained for attending the same course more than once for one renewal period.

TDLR approved continuing education (CE) hours will be required to renew a cosmetology license that expires on or after Sept 1, 2006. The hours required must be completed within the term of the license being renewed. (2 years in most instances)

Texas Occupations Code, Chapters 1602 and 1603
16 Texas Administrative Code, Chapter 83
Health and Sanitation Standards in Chapter 83; and/or
Curriculum subjects listed in 16 Texas Administrative Code, §83.120

If you mailed PCS a check the Department encourages you to call yourbank immediately and place a stop payment on the check.  If you mailed PCS a money order you should fill out the tracer requestthat was attached to it and submit the tracer to the money orderprovider. If it hasn’t been cashed you can request a new money orderwhich you can make payable to yourself to reclaim your money.  Although both the bank and money order company will charge a fee forthe services it should be less than the amount PCS is stealing fromyou. Fraudulent notices about 'professional certification'

The Texas Department of Licensing and Regulation (TDLR) is warning all cosmetology licensees that mailed notices which appear to be from the National Cosmetology Association or Professional Certification Service regarding the expiration of a “professional certification” are a scheme to take your money. Upon careful examination of the notice you will see that it refers to a “certification renewal” and NOT your license renewal. That notice has nothing to do with your Texas Cosmetology license and you should not respond to it.

The Texas Department of Licensing and Regulation and the National Cosmetology Association are not connected to that notice and are not a party to it. If you have further questions concerning this rip-off please contact TDLR at 1-800-803-9202 or by email at CS.Cosmetologists@license.state.tx.us.

HAZARD ALERT FROM THE TDLR

Hair Smoothing Products That Could Release Formaldehyde
(OSHA) The Occupational Safety and Health Administration  and several State OSHA programs are investigating complaints from hair salon owners and workers about possible formaldehyde exposure from hair smoothing products. Some of these products have been labeled as "formaldehyde-free." Oregon’s Occupational Safety and Health Administration, California's OSHA the Connecticut Department of Public Health, and several other states  have already issued warnings about these products to salon owners, stylists, other salon workers, and clients.

NIOSH, The National Institute for Occupational Safety and Health, has also completed a Health Hazard Evaluation for salon workers that assessed risks posed from using a specific hair smoothing product in a single salon. Addtionally  the FDA, the Food and Drug Administration, has issued a warning letter to the importer and distributor of Brazilian Blowout Acai Professional Smoothing Solution (GIB LLC dba Brazilian Blowout) identifying this product as adulterated and misbranded because it contains methylene glycol, which can release formaldehyde during the normal conditions of use, and because the label makes misleading statements ("Formaldehyde Free" or "No Formaldehyde").

During Federal OSHA investigations, air tests showed formaldehyde at levels above OSHA's limits in salons using Brazilian Blowout Acai Professional Smoothing Solution, labeled "formaldehyde free," and Brasil Cacau Cadiveu.

New Cosmetology Administrative Rules In Effect

At their annual meeting , the Texas Commission of Licensing and Regulation (TDLR) adopted amendments to existing rules and a new rule for the cosmetologists program. These rule changes are a second phase of rulemaking necessary to implement House Bill 2106, 80th Legislature, to adjust continuing education requirements, and to make additional clean-up changes in the rules for cosmetologists. The provisions of House Bill 2106 became effective on June 15, 2007 and require the Commission to adopt rules necessary to implement the new legislation by January 1, 2008.

Also included are changes to the continuing education requirements for cosmetologists, as recommended by the Advisory Board on Cosmetology, and a reduction in the fee for a revised/duplicate license. The adopted rules are 16 Texas Administrative Code, Chapter 83,§§83.10, 83.20, 83.22, 83.25, 83.26, 83.29, 83.31, 83.71, 83.78,83.80, and 83.100. The rule adoption was filed with the Texas Register on December 11, 2007, and published in the December 28, 2007, issue of the Texas Register (32 TexReg 9970).
